Selling a house in foreclosure, before the auction date.

If a lender has filed against you, you usually have more time and more options than it feels like. Selling before the sale date is one of them, and it is normally the one that protects the most. We are a licensed, family owned company based in Venice with more than 250 properties purchased across the Gulf Coast and 25 years in these markets.

How the timeline works in Florida

Florida is a judicial foreclosure state, which means the lender has to sue you in court rather than simply scheduling a sale. That takes time. The case begins with a lis pendens and a complaint, you have twenty days to respond, and the process from there commonly runs several months to well over a year depending on the county and whether the case is contested.

The important point is that the property remains yours until the clerk's sale actually happens. Up to that date you can sell it, and if the sale price covers what you owe, the case is resolved and the remaining equity is yours.

Why selling usually beats letting it go to auction

At auction the property typically sells for less than it is worth, and anything above the debt goes through a surplus funds process rather than straight to you. A completed foreclosure also stays on your credit for seven years and makes renting or financing harder in the meantime.

Selling beforehand means the mortgage is paid off at closing through the title company, the case is dismissed, and whatever is left over is yours. The credit outcome is substantially better than a foreclosure judgment.

What we can and cannot do

We can buy quickly, in cash, without an appraisal or a lender, which is what matters when there is a date on the calendar. We can coordinate with your lender's payoff department and your attorney, and we can close in a timeframe that fits the court schedule.

We cannot stop a foreclosure by ourselves, we are not attorneys, and we will not tell you a sale is your only option. If you have equity, a traditional listing may net you more and we will say so. If the numbers are tight or the date is close, speed starts to matter more than the last few thousand dollars. Talk to a Florida foreclosure attorney as well; this is a legal process and you should have legal advice on it.

Common questions

Foreclosure and pre-foreclosure, answered.

How late is too late to sell?
Generally the property can be sold up until the clerk's sale actually takes place. The closer to that date, the tighter things get, so earlier is always better. Call us with the sale date and we will tell you honestly whether it is workable.
Will I get any money if I sell?
If the sale price exceeds what you owe, including arrears and fees, the difference comes to you at closing. If it does not, there may be other routes such as a short sale, and we will tell you if we think that is the better path.
Is a cash sale better than letting it foreclose?
Usually, yes. A completed foreclosure is a judgment on your record for seven years and the auction price is normally well below market. A sale pays the lender, closes the case and protects whatever equity exists. It is not automatically the right answer for everyone, which is why we tell you when it is not.
Do you work with my attorney?
Yes, and we would prefer you have one. We coordinate with attorneys and lender payoff departments regularly. We are buyers, not legal advisers, and a foreclosure is a court case that deserves proper legal advice.
